In its decision, the OSC said she could not prove that Eugene Melnyk had committed an offense. The regulator, however, ruled that the businessman had acted "contrary to public interest." A hearing will be held within 30 days to determine whether these actions earned him a reprimand. In a statement Friday, Eugene Melnyk said he was relatively pleased with the decision. The allegations on which the OSC investigated were related to a series of incidents, including a traffic accident involving a truck delivery of drugs. The company officials had attributed the poor financial performance in the quarter following the collision near Chicago. The share of the company then had plummeted. The Commissioners concluded Eugene Melnyk knew or should have known that these three statements and October 8, 2003 were false. Biovail has recently merged with a California company and is now called Valeant Pharmaceuticals International (VRX T.). Melnyk is not a major shareholder of this company. |
